The model WHS laws (the model laws) have been adopted in every jurisdiction except Victoria (though its laws are broadly similar). They include the model WHS Act, model WHS Regulations and model Codes of Practice. 

When WHS ministers make a decision to change or add to the model laws such changes do not apply in a jurisdiction unless the jurisdiction has separately taken action to implement them. 

The word “model” is crucial. Safe Work Australia’s legislative remit extends only to the model WHS legislative framework. From time-to-time jurisdictions may, for local reasons, not implement changes to the model WHS laws or do so with slight variations. However, the principles underlying the WHS Acts across the states and territories are very similar.
