This is the current version of the model WHS Regulations, dated 1 August 2023, which includes all amendments made since 2011. For the model WHS Regulations to have effect in a jurisdiction it must be implemented in that jurisdiction. Amendments to the model WHS Regulations do not automatically apply in a jurisdiction.
The Model Work Health and Safety Regulations have been amended by the Parliamentary Counsel’s Committee.
In July 2023 the Model Work Health and Safety Legislation Amendment (Offences and Penalties) 2023 amended the model WHS Act and model WHS Regulations, including amending how WHS penalty provisions are expressed, increasing penalty amounts and providing for the indexation of penalty amounts.

In May 2023 the Model Work Health and Safety Regulations (Engineered Stone) Amendment 2023 introduced an express prohibition on the uncontrolled processing of engineered stone products. The amendments reflect the existing duty on persons conducting a business or undertaking (PCBU) to eliminate risks to the health and safety of workers from engineered stone and if that is not reasonably practicable, to minimise the risks so far as is reasonably practicable.
