Your privacy rights

Your personal information is protected by law, including the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), which regulate how entities including SWA may collect, use, disclose and store personal information.

SWA will only collect your personal information where it is reasonably necessary for, or directly related to, the performance of our functions or activities.

What personal information do we collect?

We collect your personal information from you when you voluntarily submit your details through Microsoft Forms, for inclusion in SWA’s Research Summit Directory (the Directory). The Directory aims to establish a limited contact list of researchers engaged in work health and safety (WHS) and workers’ compensation research to support collaboration. 

The personal information we collect from you via Microsoft Forms includes your name, contact details, organisation, social media details and research information (e.g. your research area and current research topics). 

Your information may be stored on Microsoft Forms’ servers. For more information on how Microsoft may access or use your personal information, please refer to Microsoft’s privacy statement and Security and Privacy in Microsoft Forms

Why do we collect your personal information?

We collect your personal information to establish a limited directory of researchers, to support collaboration on research relating to WHS and workers’ compensation. 

Collection of this information is authorised under section 6 of the Safe Work Australia Act 2008 (Cth), in conjunction with Australian Privacy Principle 3. 

If we do not collect your name, contact, organisation details and research information, you will not be included in the directory. The collection of your social media details is optional, and you will still be included in the directory if you choose not to provide this information. 

How do we use and disclose your personal information?

The directory, which contains your personal information, will be published on the SWA website, and linked to at the SWA Research Summit for attendees to view. As the directory will be published online, your personal information may be disclosed to overseas recipients. 

If you consent to the inclusion of your personal information in the directory, APP 8.1 will not apply to the disclosure. APP 8.1 provides that before an APP entity discloses personal information about an individual to an overseas recipient, the entity must take reasonable steps to ensure that the recipient does not breach the APPs in relation to that information. If you consent to the disclosure and the overseas recipient handles your personal information in breach of the APPs, SWA will not be accountable under the Privacy Act and you will not be able to seek redress under the Privacy Act.

SWA may develop and publish future directories to support collaboration on research relating to WHS and workers’ compensation. Your personal information may be used in these future directories and published on the SWA website. If you give consent for your personal information to be included in future SWA directories, APP 8.1 will not apply to the disclosure.

We may also use your personal information to contact you about future SWA research activities. You may choose to opt out of this if you do not wish to be contacted by SWA in this way.
