This guide has recently been updated to reflect amendments to Right of Entry provisions in the Fair Work Act 2009 (Fair Work Act). The Fair Work Amendment (Closing Loopholes) Act 2023 amended the Fair Work Act to remove the requirement for union officials assisting a health and safety representative to hold an entry permit under the Fair Work Act. More information about the changes to the Fair Work Act can be found on the Fair Work Commission website.

The guide covers the representation and participation of workers in health and safety matters at the workplace. It also provides guidance on resolving health and safety issues.  

Use this guide if you’re a person conducting a business or undertaking (PCBU) and you employ workers or if you are a worker and want to find out about work health and safety representation and participation.
